These Terms and Conditions ("Terms") govern the access and use of the services provided through www.myjinny.com and/or mobile application of Zaradrus Technologies Private Limited named as MyJinny (collectively, the “Platform”), including the services made available (the “Services”). The Supplemental Terms and the Privacy Policy are essential components of these Terms. The Supplemental Terms will take precedence over these Terms if there is a discrepancy with regard to the relevant Services.
These Terms constitute a legally binding agreement between you (the “User”, “you”, or “Customer”), whether as an individual being as the user of the Services or as an individual or entity booking the Services listed on the company’s Platform on behalf of the end user or Customer, and Zaradrus Technologies Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at HQ27 Sector 27 Gurugram,122002(“Company,” “we,” “us,” or “our”). By using the Platform or Services, you agree to comply with and be legally bound by these Terms. If you are using the Platform or Services on behalf of another person or entity, you confirm and represent that you have the full legal authority and consent to bind that person or entity to these Terms.
You acknowledge and agree that you have read, understand, and are bound by these Terms—which may be updated from time to time—and that you will follow their rules by using the Services. Any previous written agreements with you are specifically superseded by these Terms. If you do not meet the requirements listed below or agree with these Terms, please do not use the Services.
- SERVICES
- The Platform allows users to book various at-home services from independent third-party providers (“Vendors”). The Company facilitates the transfer of payments to these Vendors for Services they deliver and also collects payments on their behalf.
- Unless stated otherwise in a separate Agreement, the Platform is intended solely for personal, non-commercial use within India. If you access the Services from outside India, you agree to be bound by Company’s terms and conditions applicable to Indian jurisdiction.
- The Company’s Services may be offered under various brand names owned by the Company or licensed for its use.
- As part of providing its Services, the Company and its affiliated entities may send you messages via SMS, email, or WhatsApp regarding your bookings, service usage, or for marketing purposes. If you opt out of receiving such communications, it may limit or affect your ability to access certain features or aspects of the Services.
- Company’s Credits:
- The Company may issue promotional codes that can be redeemed for service credits, features, or benefits (“promotional Credits”), subject to applicable terms.
- You agree to use these Credits legally and as intended. You must not sell, duplicate, transfer, or share codes publicly without the prior written consent of the Company. Credits have no cash value, may expire, and can be disabled without liability.
- The Company may offer these Credits selectively to different users, which could lead to varied pricing for similar Services.
- The Company reserves the right to withhold or revoke Credits or benefits if it suspects misuse, fraud, or any violation of applicable terms.
- ACCOUNT REGISTRATION
- To use the Services on the Platform, you must first create an account on the Platform ("Account”). During registration, you need to provide certain information, such as your phone number. You must be at least 18 years old to open an Account.
- The User confirms that all the information provided for the account creation is accurate and in case of any change, the User agrees to change/update it promptly on the Platform.
- The User shall be fully responsible for keeping your Account secure and confidential. If your Account is compromised or used without your permission, you must notify the Company immediately.
- The User is accountable for all actions taken through their Account, including those by others. The Company is not responsible for any unauthorized access to your Account.
- The User consents to receive communications from the Company, which may include (i) payment-related requests, (ii) updates about the Services, (iii) promotional content from the Company or our partners, and (iv) other information related to the Services.
- USER CONTENT
- The User after registering an account with the Company, shall share content such as comments, reviews, feedback, ideas, or suggestions through the platform (collectively referred to as “User Content”).
- The Company may request the User to review the Vendors Service to help maintain the quality of the Services. The User agrees to the condition that Vendor might also be asked to review the User. The User shall not submit any false or misleading reviews. These reviews help the Company assess Platform quality and determine the suitability of Users—both Customers and Vendors. If the Company at any time finds that the User is not a suitable User, the Company reserves the right to suspend or terminate User’s account at the sole discretion of the Company.
- The User agrees to the Company that by sharing User Content, it grants the Company a global, non-exclusive, transferable, sublicensable, royalty-free, irrevocable, and perpetual license to: (i) use, display, store, host, modify, translate, distribute, and create derivative works from the User’s content as needed to provide and enhance the Services; of the Company and (ii) use it for marketing, promotional, or evidentiary purposes.
- The User waives any rights they might have (such as moral rights) in relation to the User Content for the purposes outlined in these Terms and the license that User has granted to the Company.
- The User agree that the Company may, at its discretion and without prior notice, remove or restrict access to any User Content that violates these Terms.
- CONSENT TO USE DATA
- The User agrees that the Company shall collect and use the personal information of the User as described in the Privacy Policy, which is available on Company’s Platform. The Privacy Policy of the Company clearly explains the types of personal data which is collected or handled to process the information.
- In addition to any permissions granted under the Privacy Policy, the User also agrees to sharing the information with: the Company’s affiliated entities, and the Vendors.
- The Company may use data for various purposes, including delivering the Services, conducting analytics, identifying trends, generating statistics, improving service performance, offering promotions and benefits, and enhancing overall User experience.
- In compliance with applicable laws, the Company may be obligated to share User’s information with law enforcement agencies, government bodies, or other authorized entities in connection with criminal or civil legal proceedings. The User acknowledges and agree that the Company may disclose such information when required by law.
- SERVICE BOOKINGS
- The Platform allows Users to book services provided by the Vendors. The Company acts only as a technology intermediary, facilitating the transaction between Users and Vendors.
- The Company does not employ the Vendors, nor does it supervise or control the performance of Services by the Vendors. The Company makes no representations or warranties as to the quality, safety, legality, or suitability of Services rendered by the Vendors.
- The User can requests through the Platform by selecting available time slots and providing necessary details for the Services. The Company tries to match the User with the Vendor and confirm the booking via SMS, email, or notification. Payment is required once the booking is confirmed.
- Bookings cancelled before confirmation will not be charged.
- PRICING AND PAYMENT
- Service Charges and Fees: User may be charged for different Services and features on the Platform. A convenience fee may also apply. All charges include taxes.
- Payment Terms: Payments can typically be made via cards, UPI, net banking, wallets, or cash (if available). The User will be informed of the applicable charges and payment options at booking. If the User pays by cash, then User shall pay both service and platform fees directly to the Vendor.
- Non-Refundable & Variable Pricing: Charges are generally non-refundable unless otherwise stated by the Company or required by law. Prices may increase in high-demand areas or peak times, and the Company reserves the right to revise charges, which will affect already confirmed bookings.
- Cancellations & Subscriptions: If the User cancels before the professional arrives, a cancellation fee may apply based on the Company’s policy which will be informed at the time of cancellation. The Company may also offer subscription plans with added benefits and discounts, subject to separate terms.
- Payment Processing & Tips: Payments may be handled by third-party processors and are subject to their terms. The Company does not treat any part of the User’s payment as a tip. Tipping is optional and at the discretion of the User.
- CUSTOMER CONDUCT
- Non-Discrimination: The Company strictly prohibits any form of discrimination against Vendors based on race, religion, caste, gender, age, disability, sexual orientation, marital status, or any other protected characteristic under applicable law. Refusing Services on such grounds is not permitted.
- Respectful Conduct & Safe Environment: The User is expected to treat Vendors with courtesy and ensure a safe, clean, and appropriate location for service delivery. Vendors may decline to perform Services if these conditions are not met or if they are subjected to disrespectful or abusive behavior. The Company reserves the right to restrict or suspend User’s access to the Services in such cases.
- Liability & Incident Reporting: The User is liable for any discriminatory actions or failure to provide a proper service environment, whether intentional or not. The User must disclose any relevant information that may affect the Vendor’s ability to perform Services safely. Any misconduct by a Service Professional must be reported to Customer Support within 48 hours of the incident.
- THIRD PARTY SERVICES
- The Platform may include links to, or content and services provided by, third parties ("Third-Party Services"). These are the sole responsibility of the respective third parties, and the User can access or use them at their own discretion and risk.
- The Company does not guarantee the accuracy, reliability, or completeness of any Third-Party Services and disclaims all related warranties and liabilities. When User uses such services, the User is subject to the terms, conditions, and privacy policies of the respective third-party providers. All intellectual property related to these services belongs to those third parties.
- YOUR RESPONSIBILITIES
- Accuracy of Information: The User confirms that all information and documentation User provides while using the Services is complete, accurate, and up to date. The User must promptly notify the Company of any changes. The Company is not responsible for any loss arising from incorrect, incomplete, or misleading information or User’s failure to disclose material facts.
- User Cooperation and Conduct: The User agrees to fully cooperate with the Company in the event of legal proceedings caused by User’s breach of these Terms. The User must not engage in activities that interfere with or disrupt the Services, or attempt unauthorized access to any part of the Platform or its systems through hacking, password mining, or other illegitimate methods.
- User Content Responsibilities: The User represents and warrant that:
- User owns or have permission to use all rights in your User Content and are authorized to grant licenses under these Terms.
- User’s User Content does not infringe intellectual property, privacy, or publicity rights, contain viruses or harmful code, or breach third-party rights or contracts.
- User’s Content does not promote or incite illegal acts, defame others, or include content that is obscene, discriminatory, violent, racist, hateful, or otherwise offensive under applicable law or public policy.
- Prohibited Use of Services: User agrees not to misuse the Services. This includes, but is not limited to:
- infringing proprietary rights or violating intellectual property laws.
- Distributing harmful software or malware.
- Using bots, spiders, or automated tools to access, copy, or monitor the Services.
- Systematically extracting content to build databases or directories.
- Engaging in illegal, fraudulent, or malicious activities.
- Reverse-engineering, modifying, mirroring, or framing any part of the Services.
- Violating any applicable laws or using the Services in ways inconsistent with these Terms.
- Non-Solicitation of Service Professionals: User agrees not to solicit, approach, or influence Vendors—whether directly or indirectly—to terminate their association with the Company or to provide similar services outside the Platform. This clause protects the privacy and engagement of Vendors and is considered fair, reasonable, and necessary. User remains free to avail similar Services through the Platform or other sources without bypassing the booking process.
- INTELLECTUAL PROPERTY
- The Company owns or holds all rights to the Services, including all intellectual property therein. The User is granted a limited, non-transferable, non-sublicensable, revocable license to use the Services strictly in accordance with these Terms and any instructions the Company may issue.
- If the User shares any feedback, suggestions, or bug reports about the Services (“Feedback”), the Company may use it freely—including copying, publishing, distributing, or modifying—without owing User any compensation or acknowledgment.
- Unless explicitly stated in these Terms, no license or right is granted to the User in relation to any intellectual property owned by the Company or any third party.
- TERMINATION AND DURATION
- These Terms remain in effect until either party terminates them in accordance with the terms hereunder.
- The Company may suspend or terminate User’s access to the Services, in whole or in part, with or without notice: i. immediately, if User violate any part of these Terms, breach Company’s community guidelines, or no longer meet legal or internal eligibility criteria; ii. Upon 30 days’ prior written notice, for any other legitimate reason including business or legal requirements.
- The User may terminate their use of the Services and these Terms at any time by notifying us.
- Upon termination: User’s account will be deactivated, access to the Services will cease; and any provisions intended to survive termination—explicitly or by implication—will remain enforceable.
- EXCLUSIONS AND WARRANTIES
- The Services are offered “as is” without any warranties of any kind—express, implied, statutory, or otherwise. This includes, but is not limited to, warranties of title, merchantability, fitness for a particular purpose, and non-infringement.
- The Company does not guarantee the accuracy, reliability, or timeliness of information or Services on the Platform.
- The User agrees and understands that the Company is merely a facilitator, connecting Users with the Vendors.
- INDEMNITY
User agrees to indemnify and hold harmless the Company, its parent companies, subsidiaries, affiliates, employees, agents, and officers from and against all claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:
- use or misuse of the Services;
- any violation of these Terms by the User or anyone using User’s account;
- any harm caused to third parties due to the User’s actions while using the Services.
- JURISDICTION, GOVERNING LAWS, AND DISPUTE RESOLUTION
- These Terms are governed by the laws of India. All disputes shall fall under the exclusive jurisdiction of the courts in Gurugram, Haryana.
- Any conflicts or disputes arising from these Terms will be settled through arbitration in Gurugram, Haryana under the Arbitration and Conciliation Act, 1996. The proceedings will be conducted in English, and a single arbitrator will be appointed by the Company.
- Arbitration proceedings will be confidential, and each party shall bear its own legal costs. The arbitrator's decision will be final and binding.
- GRIEVANCE REDRESSAL
- If User has any concerns, complaints, or disputes regarding the Services or these Terms, User may contact our designated Grievance Redressal Officer via email or registered post.
